1 Scope and subject matter of the data protection declaration

The purpose of this data protection declaration is to provide information on what personal data we collect via the website, which can be accessed at www.dtc-solutions.de, and for what purpose we process this data. Where links are provided to other sites, we have neither influence nor control over the linked content and the data protection provisions there. We recommend that you check the data protection statements on the linked websites to determine whether and to what extent personal data is collected, processed, used or made available to third parties.

 

2 Important Definitions and Terms

First of all, you will find a selection of some legal definitions which may be helpful to you in understanding the data protection declaration. The full text of the General Data Protection Regulation (GDPR), including further definitions and terms, is available at the following link.

 

Personal data: This is any information relating to an identified or identifiable natural person – an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing: means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Controller: means the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for under Union or Member State law.

Recipient: means a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not a third party. However, public authorities that may receive personal data in the context of a specific investigative task under Union or Member State law shall not be considered as recipients. The processing of such data by the said authorities shall be carried out in accordance with the applicable data protection rules, in accordance with the purposes of the processing.

Third party: This is a natural or legal person, public authority, agency or other body, other than the data subject, the controller, the processor and the persons authorised to process the personal data under the direct responsibility of the controller or the processor.

5. Log files

We collect so-called access data when you call up our website and store this in a log file (so-called log file). This access data also includes the IP address. In addition, the name of the website accessed, the file accessed, the date and time of access, the volume of data transferred and notification of successful access, the browser type and version, the operating system, the so-called referrer URL (the previously visited page) and the requesting provider are stored in the log file.

Personal data: IP address

Purpose of data processing: We collect the log file data, including the IP address, to ensure a smooth connection setup of the website and to enable a comfortable use of our website by the users. In addition, the log file is used to evaluate system security and stability as well as for administrative purposes.

Interest in data processing: The log file data, including the IP address, are only used for technical and design optimisation of the website and to secure our systems (e.g. in the event of an attack on our IT area or a security incident). From the data in the log file, including the IP address, no personal reference can be established for us in the event of a call to our website. This can only be the case if you log into our customer portal at the same time. In this case, we can assign the IP address directly to you.

Recipients: We do not pass on the aforementioned data to third parties. Our website is operated or hosted by the following service providers, which is why these providers have at least theoretical access to the IP address:

6. Web and user analysis

So-called tracking or web analysis tools are used on our website. This describes the collection of access data on our website and the evaluation of the behaviour of our visitors for the purpose of optimising our offer. With the help of these tools, we can examine how and from where visitors come to our site, which areas on a website are visited particularly often and how often and for how long which sub-pages and categories are viewed. In addition, we can determine which search terms and websites the user has entered and evaluate how many users visit our pages in total and which information or offers are most in demand. The aim is to be able to design our offers and our website in a user-friendly way with the help of the knowledge gained in this way. By statistically evaluating the user profiles, we can derive statements about the functioning and success of our websites and functions, such as answers to questions about how often information pages on certain product groups were called up or how many visitors clicked on certain offers. With the help of the tracking tools, we can target our offer more specifically to our customers, visitors and interested parties.

 

Personal data: IP address

Purpose of data processing The tracking tools allow us to evaluate the behaviour of website visitors and analyse their interests. For this purpose, we create a pseudonymous user profile. If you also log in to your account with your user data, we can use this profile information to draw conclusions about you (profiling).

Interest in data processing: Here, we do not see any significant encroachment on the personal rights of our customers, as such profiles are created and processed using pseudonyms. In this respect, we consider the interest in an optimal preparation of information and our services to be predominant. The right to object to such profiling at any time remains unaffected, of course.

Recipients: We do not pass on your data to third parties. In the area of web and user analysis, however, we work together with professional service providers who compile user statistics on our behalf. The basis of this contractual relationship is, among other things, the obligation of the providers to have taken special precautions to protect your data and to process all personal data only in accordance with our instructions (Art. 28 DSGVO).

7. User-related advertising

So-called advertising tracking tools are used on the website. With the help of these advertising tracking tools, we can display or have displayed individual advertisements on our websites, which are selected (automatically) based on the preferences of the visitors. Technically, the advertising tracking is usually carried out via advertising IDs, where, among other things, cookies are used by the providers of advertising networks to create profiles of users and, when a website is called up, the advertisement is displayed on the basis of the cookie profile. Through the use of tracking pixels on various websites, the first time a user visits a website of the advertising partner, the advertising partner causes cookies to be stored on the end devices of the users. Through such remarketing offers, a user can be “tracked” on the internet and (supposedly) shown particularly interesting offers. In many cases, tracking is also carried out via so-called browser fingerprints, in which information such as the individual setting of screen resolution, colour depth, time zone and installed plug-ins are used to recognise users or user groups.

8. Plugins and embedded functions

We integrate functional and content elements into our online offer that are obtained from the servers of their respective providers (hereinafter referred to as “third-party providers”). These can be, for example, graphics, videos or social media buttons as well as posts (hereinafter uniformly referred to as “content”).

The integration always requires that the third-party providers of this content process the IP address of the user, as without the IP address they could not send the content to their browser. The IP address is thus required for the presentation of these contents or functions. We endeavour to only use content whose respective providers only use the IP address to deliver the content. Third-party providers may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. The “pixel tags” can be used to analyse information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user’s device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our website, as well as being linked to such information from other sources.

9. Contact form

Personal data: Name, e-mail address, subject and the corresponding message.

Purpose of data processing: We use a contact form on our website to exchange information with our customers and interested parties and to answer their concerns and enquiries. We process the enquiries and information sent to us in this context exclusively to process your enquiry and to contact you.

Duration of data storage: Duration of the processing and handling of the enquiry or until we are requested to delete it.

Provision mandatory or required: The provision of the aforementioned personal data is neither legally nor contractually required. However, it is not possible to process your enquiry without this information.

 

10. Newsletter

Personal data: Name, e-mail address

Purpose of data processing: If you register for our e-mail newsletter, we will regularly send you information about our offers, special promotions or news about our products. Mandatory data for sending the newsletter are your e-mail address and your name, so that we can address you personally. We use the so-called double opt-in procedure for sending the newsletter. This means that we will only send you an e-mail newsletter if you have expressly confirmed that you consent to the sending of the newsletter. To do this, we will send you a confirmation e-mail asking you to confirm that you wish to receive future newsletters by clicking on a corresponding link. Only by activating the confirmation link do you give us your consent to use your personal data.

When sending the newsletter, we also automatically evaluate your user behaviour. For this evaluation, the newsletters sent contain so-called web beacons or tracking pixels, with the help of which we can determine that you have received or opened the newsletter or whether you have clicked on links in the newsletter. With the data obtained in this way, we create a user profile in order to tailor the newsletter to your individual interests.

Duration of data storage: You can object to receiving newsletters and thus to the processing of your aforementioned data for the purpose of e-mail advertising (marketing) at any time. If you no longer wish to receive e-mails, you can click on the so-called “unsubscribe link” in every e-mail or contact us at datenschutz(at)dtc-solutions(.)de. This does not incur any costs other than the transmission costs according to the base rates. The lawfulness of the processing based on your consent until your revocation remains unaffected. If you also do not wish any automated evaluation and analysis of your user behaviour in connection with the newsletter, you must unfortunately unsubscribe from the newsletter service. Until then, the data will be stored as long as you have subscribed to the newsletter.

For these purposes, cookies are usually stored on the users’ computers, in which the usage behaviour and the interests of the users are stored. You have the right to request confirmation from us at any time as to whether we are processing personal data relating to you and the right to obtain information about this personal data.
